1. Acceptance of Terms

By creating an account, downloading our mobile application, or otherwise accessing or using bodyfatAI ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not use the Service.

2. Description of Service

bodyfatAI provides an AI-powered body-composition analysis service through a mobile application. The Service uses machine-learning algorithms to estimate body-fat percentage, FFMI, muscle-mass, and related fitness metrics from photos and measurements you provide, and lets you track this information over time.

Medical Disclaimer: bodyfatAI is not a medical device or service. Our analysis is for fitness and informational purposes only and should not be used as a substitute for professional medical advice, diagnosis, or treatment. Always consult a healthcare professional before making decisions about your health.

3. Eligibility

You must be at least 18 years old to create an account or use bodyfatAI. By creating an account, you represent and warrant that you are at least 18 years old and that the date of birth you provide is accurate. We may suspend or terminate accounts if we believe the user is under 18 or has provided inaccurate age information.

4. User Accounts

To use the Service, you must:

• Provide accurate and complete registration information
• Maintain the confidentiality of your account credentials
• Notify us immediately of any unauthorized access to or use of your account
• Be responsible for all activities that occur under your account
• Ensure your account information remains accurate and up to date

We cannot and will not be liable for any loss or damage arising from your failure to comply with these account-security obligations.

5. Subscription and Payment

bodyfatAI may offer subscription-based premium features through the Apple App Store, Google Play Store, or other authorized payment platforms.

• Free: $0 — basic body-fat analysis with limited scans
• BodyfatAI Premium (Monthly): $14.99/month — unlimited scans, advanced analytics, progress tracking, priority support
• BodyfatAI Premium (Annual): $119.99/year — unlimited scans, advanced analytics, progress tracking, priority support

By purchasing a subscription, you agree that:

• subscriptions are billed in advance and automatically renew unless canceled before the end of the current billing period;
• payment is charged to your Apple ID or Google Play account at confirmation of purchase, and renewal charges occur within 24 hours prior to the end of the current period unless auto-renew is turned off;
• billing, renewal, cancellation, and refunds are managed by the platform through which you purchased the subscription, and bodyfatAI does not receive your full payment card details;
• premium access remains active until the end of the current billing period after cancellation, and no refunds are provided for partial billing periods except as required by law;
• prices may change with at least 30 days' notice to existing subscribers;
• deleting your bodyfatAI account does not automatically cancel a subscription managed by Apple or Google — you must cancel it separately through your App Store or Google Play account settings to prevent future charges.

6. Free Trial

We may offer a free trial period for premium features. If you do not cancel before the trial ends, you will be automatically charged for a subscription. Trial periods are available once per user.

7. Photo Upload Rules

bodyfatAI is designed for fitness and body-composition analysis using appropriate physique photos. You agree that you will not upload, submit, or share through the Service any photo or content that:

• depicts nudity, exposed genitals, sexually explicit conduct, or sexually suggestive poses;
• depicts a person under 18 years old;
• depicts anyone other than you;
• was taken, shared, or uploaded without the subject's consent;
• is exploitative, abusive, harassing, threatening, hateful, or invasive of another person's privacy;
• contains child sexual abuse material, suspected underage sexual content, or any illegal sexual content;
• violates any law, regulation, intellectual property right, privacy right, publicity right, or contractual obligation.

You should upload only photos of yourself in underwear, swimwear, or fitted athletic clothing that is appropriate for fitness analysis. We may reject, remove, restrict, preserve, or report content that we believe violates these Terms, our safety policies, or applicable law.

Nude photos are not permitted. Uploading nude or sexually explicit photos may result in removal of the content, suspension or termination of your account, and reporting to appropriate authorities where required or permitted by law.

8. User Content and License

You retain ownership of photos, measurements, and other content you upload to the Service. By uploading content, you grant bodyfatAI a limited, worldwide, non-exclusive, non-transferable license to host, store, transmit, process, analyze, display to you, and otherwise use your content as reasonably necessary to:

• provide the body-composition analysis and progress-tracking features you request;
• operate, maintain, secure, and troubleshoot the Service;
• provide customer support;
• detect, prevent, and investigate abuse, fraud, security incidents, or Terms violations;
• comply with law, legal process, and safety obligations.

We do not use your scan photos to train AI models unless you separately opt in or we otherwise disclose that use and obtain any required consent.

9. Leaderboard Feature and Verification

bodyfatAI offers an optional leaderboard feature where you can choose to have your body-composition metrics and verified scan photo displayed publicly. This feature is entirely voluntary; you can opt in to participate or opt out at any time.

Mandatory Verification Requirement: All leaderboard entries are subject to mandatory verification by bodyfatAI staff to ensure authenticity and accuracy. This verification is a requirement for leaderboard participation. bodyfatAI staff will review your submitted scan photo to verify:

• It depicts a real person (not AI-generated, altered, or fraudulent)
• The body measurements and estimates are realistic

Verification Outcomes:

• If verification is accepted: Your metrics and verified photo are displayed on the public leaderboard and retained indefinitely while your leaderboard entry is active (an exception to the standard 30-day data retention policy).
• If verification is rejected: Your leaderboard listing is removed, your photo is not displayed, and you are automatically opted out of the leaderboard feature. You may submit a different scan photo to be re-evaluated.

Once a leaderboard entry is created and verified, your photo and metrics become part of the public leaderboard record and may be cached or archived by third parties. You can voluntarily remove your leaderboard entry at any time, but acknowledge that cached/archived copies may persist beyond removal.

Account Deletion: If your account is deleted, your leaderboard entry is automatically removed and cannot be recovered.

Privacy Implications: By participating in the leaderboard, your body-composition metrics (body fat %, FFMI, BMI, etc.) and verified scan photo will be publicly associated with your username and visible to all users of the Service. Consider the reputational and privacy implications before opting in.

10. Acceptable Use

You agree not to:

• use the Service for any illegal or unauthorized purpose;
• attempt to gain unauthorized access to our systems;
• interfere with or disrupt the Service or servers;
• use automated systems to access the Service without permission;
• reverse engineer, decompile, or disassemble our software or AI algorithms;
• create multiple accounts to circumvent restrictions;
• share your account credentials with others;
• use the Service to harass, abuse, or harm others;
• attempt to extract or scrape data from the Service;
• use the Service for commercial purposes without our authorization.

11. Safety Enforcement and Illegal Content

We may remove or restrict access to content, suspend or terminate accounts, preserve relevant information, and report information to law enforcement, NCMEC, or other appropriate authorities if we believe content or activity may involve child exploitation, non-consensual intimate imagery, threats, abuse, fraud, illegal activity, or other serious violations of these Terms.

12. Intellectual Property Rights

bodyfatAI and its licensors own all rights, title, and interest in and to the Service, including all software, algorithms, text, graphics, and logos, protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use in accordance with these Terms.

13. Data Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand how we collect, use, and protect your information.

14. Fitness and Medical Disclaimer

bodyfatAI provides estimated body-composition information for general fitness, wellness, and informational purposes only. Results, including body-fat percentage, FFMI, BMI, muscle-mass estimates, visual feedback, strong points, and areas for improvement, are estimates and may be inaccurate or incomplete.

bodyfatAI is not a medical device and does not provide medical advice, diagnosis, treatment, or prevention of disease. Do not use bodyfatAI results to make medical decisions. Consult a qualified healthcare professional before making decisions related to health conditions, eating disorders, body image concerns, exercise limitations, medication, diagnosis, treatment, or major diet or training changes.

15. Disclaimers and Limitation of Liability

bodyfatAI is provided "as is" and "as available" without warranties of any kind. We strive to provide reliable service but cannot guarantee the Service will be available at all times. To the maximum extent permitted by law, bodyfatAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the past 12 months.

16. Indemnification

You agree to indemnify and hold harmless bodyfatAI and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

17. Service Modifications

We reserve the right to modify, suspend, or discontinue the Service at any time without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

18. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time through the app settings. Upon termination, your right to use the Service immediately ceases, and we may delete your account and data in accordance with our Privacy Policy.

19. Account Deletion

You may delete your account through the app settings or through our account deletion web resource. When you delete your account, we remove your account from active use and delete or de-identify associated personal data as described in our Privacy Policy. Certain anonymized or de-identified transaction records may be retained for accounting, tax, subscription auditing, fraud prevention, and business analytics. Scan photos and scan records are soft deleted immediately and removed from active use, but may remain temporarily in backup, archival, or operational systems until our deletion cycle is complete.

Deleting your bodyfatAI account does not automatically cancel a subscription managed by the Apple App Store or Google Play Store. See Section 5 above and our Delete Account page for instructions on canceling your subscription directly through the platform where you subscribed.

20. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict-of-law principles. Subject to any rights you may have under applicable consumer protection laws, any disputes arising from these Terms or your use of the Service shall be resolved in the courts of the United States.

21. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the app. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

22. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and bodyfatAI regarding the Service.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms.
